Alameda Ex Parte Deadlines: No Procedure Rule, and No Portal Reservation

No Alameda local rule sets out general civil ex parte procedure. Rule 3.650 covers unlawful detainer stays, Rule 3.27 covers e-filing, and Rule 3.30(c) covers courtesy copies. The court states directly that California Rules of Court 3.1200 et seq. applies, so notice runs on the statewide clock. One exception is local: a stay under Rule 3.650 requires at least 24 hours notice by telephone or in person. No local ex parte filing cutoff was found either. Alameda’s direct calendar department schedules sit behind the eCourt portal login and are not on the public web.

Two requirements are easy to miss. The reservation is required, and the court says it cannot be obtained through the portal. Ex parte reservations are obtained from the courtroom. That runs opposite to Rule 3.30(b), which routes motion reservations to the eCourt portal. No lead time is published. The second requirement is Rule 3.30(c), which requires a courtesy copy delivered to the courtroom clerk the same day as filing for any matter heard two court days or fewer from filing. That trigger captures nearly every ex parte. Represented parties must also e-file under Rule 3.27(a).

The rule, before you enter anything

Notify all parties no later than 10:00 a.m. on the court day before the ex parte appearance. CRC 3.1203(a). That is a clock deadline, not a date deadline. It is not extended by mail or electronic service, and if the day before the hearing is not a court day the deadline moves to the preceding court day, never the following one.

Then there is the county filing deadline, which is usually the one that bites. Enter a date and pick your county.

If your case is on a direct calendar, the Dept. 511 times tell you nothing about yours.
